The Short Version

  • We provide a platform for content creators to manage their business.
  • You own your content. We never sell your data.
  • We can suspend accounts that violate these terms.
  • Disputes go to arbitration, not court (except small claims).

1. Who We Are and What We Build

MediaCreators operates mediacreators.io, a SaaS platform that provides content creators with analytics intelligence (Creator Business Score), video streaming infrastructure, audience monetization tools, and membership management - functioning as a business layer on top of platforms like YouTube, Instagram, and TikTok.

These Terms govern your use of our platform, APIs, and any related services (collectively, the "Service").

2. Acceptance

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm you meet this requirement. We do not knowingly provide services to minors.

4. Your Account

You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Keeping your account information accurate and current

Notify us immediately at legal@mediacreators.io if you suspect unauthorized access to your account.

Google Sign-In: If you authenticate via Google OAuth, you authorize us to receive your name, email, and profile picture from Google. We do not receive your Google password or access to your Google account beyond what you explicitly authorize.

5. What You Can Do With the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes as a content creator or creator business operator.

6. What You Cannot Do

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse engineer, decompile, or extract our source code
  • Scrape, crawl, or bulk-extract data from the platform beyond normal API usage
  • Use the Service to build a competing product
  • Upload content that infringes third-party intellectual property
  • Impersonate another person or entity
  • Circumvent any access controls or security measures
  • Upload malware, viruses, or harmful code

7. Your Content

7.1 You Own Your Content

Any content you upload, stream, or publish through the Service ("Creator Content") remains yours. We claim no ownership over it.

7.2 License You Give Us

To operate the Service, you grant MediaCreators a limited, worldwide, royalty-free license to:

  • Host, store, and deliver your Creator Content to your audience
  • Create technical copies necessary for streaming and delivery
  • Generate analytics and performance data from your content
  • Train AI/ML models on your content just to improve your own business

This license is solely to operate the Service for you and ends when you delete the content or close your account.

7.3 What We Will Never Do

We will never:

  • Sell your Creator Content to third parties
  • Distribute your Creator Content outside the Service without your authorization
  • Use your Creator Content to train AI/ML models for general use

7.4 Content Standards

You are responsible for ensuring your Creator Content:

  • Does not infringe third-party intellectual property
  • Complies with all applicable laws
  • Does not contain harmful, abusive, or illegal material

We reserve the right to remove content that violates these standards.

8. DMCA and Copyright

MediaCreators respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

To report copyright infringement:

Subject line: "DMCA Takedown Notice"
Include: description of the copyrighted work, URL of the infringing content, and your contact information.

We will respond to valid notices promptly and in accordance with the DMCA safe harbor provisions (17 U.S.C. Sec. 512).

9. Third-Party Integrations

The Service integrates with third-party platforms including YouTube, Instagram, TikTok, Google, Stripe, and others. Your use of these integrations is also subject to those platforms' own terms of service. We are not responsible for third-party platform actions, including policy changes that affect your account or content.

YouTube API Services: If you connect your YouTube account, your use is additionally subject to the YouTube Terms of Service and Google Privacy Policy.

MediaCreators is an independent product and is not endorsed by, sponsored by, or affiliated with YouTube or Google. References to other third-party brands (for example, Netflix) are nominative only and do not imply endorsement or affiliation.

We may reference third-party creator names, handles, logos, and channel identifiers for nominative and informational purposes, including search, analytics previews, and public estimate pages. Such references do not imply partnership, sponsorship, endorsement, or affiliation with the respective rights holders.

If you are a rights holder and believe a name, logo, or identifier should be removed or corrected, contact legal@mediacreators.io and we will review the request promptly.

10. Analytics and Creator Business Score (CBS)

The Creator Business Score (CBS) is an informational metric generated from publicly available data and data you provide. It is:

  • An estimate, not a guarantee of any business outcome
  • Subject to change as underlying data changes
  • Not financial or investment advice

We may compute CBS metrics using public data (YouTube, Instagram, TikTok, etc.) before you create an account, as part of our free intelligence layer. By claiming your profile, you consent to this use.

Public estimate pages (including /x/<creator-handle>) may display modeled revenue potential ranges and related score outputs before account connection. These outputs are provided for informational purposes only, are not guarantees of business performance, and may change based on data recency, data quality, platform changes, and account-connected signals.

MediaCreators may provide growth strategy and implementation support under paid plans, but no advisory service guarantees a specific income, conversion, or growth result.

Trademark and product notice: "Creator Business Score", "CBS", "Login with my sub™", and "Smart Ads Engine™" are proprietary MediaCreators product identifiers and may be protected as trademarks, service marks, or trade dress where applicable. You may not use our marks in a way that implies endorsement, partnership, or origin without prior written permission.

Related methods, systems, and implementation flows behind these products may also be subject to current or future patent filings and other intellectual property protections where applicable.

11. Payments and Subscriptions

11.1 Fees

Paid features are billed in advance. All fees are in USD unless otherwise stated. By subscribing, you authorize us to charge your payment method on a recurring basis.

11.2 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until that date.

11.3 Refunds

We do not offer refunds for partial months or unused service. Exceptions may be made at our discretion or as required by law (including consumer protection laws in your jurisdiction).

11.4 Payment Processor

Payments are processed by Stripe. We do not store your full payment card details. Stripe's privacy policy applies to payment data.

12. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you also agree to our Privacy Policy.

13. Termination

13.1 By You

You may close your account at any time by contacting us at legal@mediacreators.io or through your account settings.

13.2 By Us

We may suspend or terminate your account if you:

  • Materially breach these Terms
  • Fail to pay fees when due
  • Engage in fraudulent or harmful activity

We will provide reasonable notice before termination except in cases of serious violations or legal requirements.

13.3 Effect of Termination

Upon termination:

  • Your access to the Service ends
  • Your Creator Content will be retained for 30 days, after which it will be deleted
  • You may request a data export within that 30-day window
  • Payment obligations for services already rendered survive termination

14. Service Availability and Changes

We aim for high availability but do not guarantee the Service will be available at all times. We may modify, suspend, or discontinue features with reasonable notice. Material changes that reduce core functionality will be communicated at least 30 days in advance.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE PRIOR 12 MONTHS OR (B) $100 USD.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

These limitations do not apply to: (i) our gross negligence or willful misconduct; (ii) our obligations under the Privacy Policy; or (iii) liability that cannot be limited by applicable law.

17. Indemnification

You agree to defend and hold harmless MediaCreators and its team from claims arising out of your use of the Service, your Creator Content, or your violation of these Terms.

18. Dispute Resolution

18.1 Good Faith First

Before filing any formal claim, both parties agree to attempt to resolve disputes informally for 30 days by contacting legal@mediacreators.io.

18.2 Arbitration

Unresolved disputes will be settled through binding arbitration under AAA Commercial Rules in Delaware. Exception: Either party may bring claims in small claims court for disputes within that court's jurisdiction.

18.3 Class Action Waiver

All claims must be brought individually, not as part of a class action or representative proceeding.

18.4 Time Limit

Any claim must be filed within one (1) year of the event giving rise to the claim.

19. Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

20. Changes to These Terms

We may update these Terms. For material changes, we will notify you by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

21. General

  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and MediaCreators.
  • Severability: If any provision is unenforceable, the rest remain in effect.
  • Assignment: We may assign these Terms without your consent as part of a merger or acquisition. You may not assign your rights.
  • No Waiver: Failure to enforce any provision is not a waiver of our right to enforce it later.
